About these Terms
These Terms apply to your use of bear-beach-walks.com and to Bear Beach Walks memberships purchased through the site.

By purchasing a membership, you enter into an agreement with the operator of Bear Beach Walks subject to these Terms and any mandatory consumer rights that apply to you.
About Bear Beach Walks
Bear Beach Walks provides public beach guides and articles together with paid streaming access to a library of full-length 4K and interactive 360 beach-walk videos.
The project documents everyday public beach life, principally around Barcelona and Catalunya.
Because beach culture in Spain and other Mediterranean destinations can include topless sunbathing, naturist areas and other aspects of normal public beach life that some viewers may regard as adult content, membership is intended for people aged 18 or over.
Scenes are not staged for members. They reflect the public beach environment recorded during the walk.
Membership plans
Different membership plans provide access to different parts of the Bear Beach Walks library.
The exact content included with each plan, its price and its billing period are shown on the membership and checkout pages before purchase.
Depending on the plan selected, membership may provide access to the 4K Beach Walk library, the interactive 360 Beach Walk library, or both.
Membership provides streaming access only while the relevant membership remains active. Purchasing a membership does not transfer ownership of any video or other content.
Videos are not currently offered for download.
The video library
Bear Beach Walks maintains an established archive and adds new walks as they are filmed, processed and ready to publish.
We do not guarantee a fixed number of new uploads per week or month.
Our normal approach is to retain older walks as the archive grows. However, particular videos or features may occasionally need to be removed, replaced or changed for legal, privacy, editorial, technical, hosting or other reasonable operational reasons.
We therefore do not guarantee that every individual video will remain available permanently.
Video quality and compatibility
We aim to provide video at the quality described for the relevant content, subject to the viewer’s device, browser, internet connection and the processing and streaming systems used by our video provider.
Member videos are currently delivered using Vimeo.
Streaming quality may adapt automatically according to connection and device capability, and third-party video processing may affect the precise appearance or bitrate of streamed video.
Interactive 360 playback requires a compatible browser, device or application.
Prices and payment
The membership price, currency and billing interval are shown before checkout.
Payments are currently processed through PayPal. Depending on location and PayPal availability, customers may also be offered debit or credit card payment through PayPal without needing to use a PayPal account.
Bear Beach Walks does not store your full payment-card details.
PayPal may identify the merchant as Photography by Bryan, the established UK business through which Bear Beach Walks is operated.
Your Bear Beach Walks order or invoice, identifies the membership purchased.
Automatic renewal
Monthly and annual memberships are recurring subscriptions.
Unless cancelled before the next renewal date, your membership will automatically renew at the billing interval shown when you subscribed, and the relevant payment method may be charged.
The price and renewal interval are shown before you complete the purchase.
Cancelling future renewals
You can normally cancel future renewals through your Bear Beach Walks account dashboard.
Cancelling stops the next recurring payment. Unless otherwise stated or required by law, you will normally continue to have access until the end of the membership period you have already paid for.

If you contact us before your renewal date clearly requesting cancellation, we will treat the cancellation request as having been received on the date you contacted us, even if we need to make the change manually afterwards.
Immediate access to digital content
Bear Beach Walks memberships provide digital streaming content and access normally begins shortly after successful payment.
UK consumers ordinarily have cancellation rights for many distance contracts. Different rules apply when digital content is supplied immediately.
Where you request immediate access during checkout, you may be asked to expressly consent to supply beginning immediately and acknowledge that beginning supply of the digital content affects your normal 14-day cancellation right.
Where that acknowledgement is required and has been given, access can begin immediately rather than waiting for the normal cancellation period.
This does not affect legal rights relating to digital content that is faulty, materially misdescribed or otherwise does not meet applicable consumer-law requirements.
Payment, access and technical problems
If you experience a payment, account, membership-access or technical problem, please contact us.
We will investigate the circumstances and work with you to find an appropriate solution.
Depending on the situation, this may include correcting an account problem, restoring access, helping with cancellation, correcting a billing problem or providing another appropriate remedy.
Refund requests are considered according to the individual circumstances and applicable consumer law.
Nothing in these Terms excludes or limits consumer rights that cannot legally be excluded.
Accidental or disputed renewals
If you believe a membership renewed in error, contact us as soon as reasonably possible at hello@bear-beach-walks.com.
We will review the circumstances, including any previous cancellation request, account issue or technical problem, and respond fairly in accordance with these Terms and applicable consumer law.
Your account
You are responsible for keeping access to your Bear Beach Walks account reasonably secure.
Your account is associated with the email address used when joining Bear Beach Walks. This may differ from the email address associated with your PayPal account.
If you cannot remember which email address you used or have difficulty accessing your membership, contact hello@bear-beach-walks.com.
You may choose the name displayed on your Bear Beach Walks account. Payment providers may separately require accurate billing information.
Personal use of membership
Membership access is supplied for personal, non-commercial viewing.
You must not reproduce, copy, record, download, redistribute, sell, licence, publicly display, republish or commercially exploit Bear Beach Walks videos or other protected content without permission.
You must not deliberately circumvent membership restrictions, access controls, streaming protections or other technical measures intended to protect the content.
You must not use automated systems to scrape, archive or systematically copy member content.
Intellectual property
Unless otherwise stated, the videos, photographs, written content, graphics, site materials and other original content published by Bear Beach Walks are protected by applicable intellectual-property law.
Purchasing a membership grants you a limited right to access the relevant content for personal viewing while your membership is active.
It does not transfer copyright or ownership of the content to you.
Unacceptable use
You must not use Bear Beach Walks unlawfully or in a way that intentionally interferes with the operation, security or availability of the site.
We may take reasonable action where an account is used for fraud, unauthorised redistribution, deliberate circumvention of access controls, serious security abuse or other material breaches of these Terms.
Suspension or termination
We may suspend or terminate access where reasonably necessary because of a serious or repeated breach of these Terms, fraudulent or reversed payment, misuse of the membership system, attempts to copy or redistribute protected content, security threats or unlawful use.
Where appropriate and reasonably practical, we will attempt to resolve ordinary account or payment problems before terminating access.
Nothing in this section affects rights that either party has under applicable law.
Website and service availability
We aim to keep Bear Beach Walks and its video library available and functioning reliably.
Like any internet service, occasional interruptions can occur because of maintenance, hosting problems, internet connectivity, third-party services, video providers, payment systems, updates or circumstances outside our reasonable control.
We do not promise uninterrupted or error-free availability at every moment.
Where an issue materially prevents a member from accessing a service they have paid for, contact us, and we will investigate and work to put the problem right.
Third-party services
Bear Beach Walks relies on established third-party services for parts of its operation, including services such as PayPal for payments, SureCart for e-commerce and membership administration, Vimeo for streaming, and website-hosting and analytics services.
Those services may have their own terms and privacy arrangements covering their direct relationship with users.
Our use of personal information is described separately in the Bear Beach Walks Privacy Policy.
Privacy
Personal information is handled in accordance with our Privacy Policy.
Purchasing or using a Bear Beach Walks membership does not mean that every use of personal information is based on your consent. Information may also be processed where necessary to provide your membership, comply with legal obligations, protect the service or pursue other lawful purposes explained in the Privacy Policy.
Changes to memberships, prices or these Terms
We may occasionally change membership features, prices or these Terms.
A price change will not retrospectively alter a membership period that has already been paid for.
Where a change materially affects an existing recurring membership, we will provide notice where required and give members any cancellation or other rights required by applicable law.
Minor administrative, technical or clarification changes may take effect when published.
The date at the top of this page shows when these Terms were last materially updated.
Governing law and consumer rights
Bear Beach Walks is operated by a UK sole trader.
These Terms are governed by the applicable laws of the United Kingdom, subject to any mandatory consumer protections that apply to you because of where you live.
Nothing in these Terms is intended to remove rights that applicable consumer law says cannot be excluded or restricted.
